Terms of Service

1. Acceptance of terms

By creating an account or using CaveLivre ("the Service"), you agree to be bound by these Terms of Service. The Service is operated by Brendan Maguire, Perth, Western Australia, Australia ("we", "us", "our").

If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these terms.

2. The service

CaveLivre provides a personal wine cellar management application including inventory tracking, tasting notes, occasion planning, AI-powered sommelier recommendations, and wine label scanning.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice. We will provide at least 30 days' notice for discontinuation of the Service as a whole.

3. Account

• You must be 18 years of age or older to create an account.
• You are responsible for keeping your login credentials secure.
• One account per person. You may not share accounts.
• You must provide accurate information during registration.
• Notify us immediately if you suspect unauthorised access: [email protected].

4. Subscription & billing

Billing

Subscriptions are managed and billed through the Apple App Store or Google Play Store. Your payment details are held by Apple or Google — we do not receive or store your credit card number.

Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period. You can cancel at any time in your device's subscription settings (iOS: Settings → Apple ID → Subscriptions; Android: Play Store → Subscriptions).

Refunds

Refund requests are handled by Apple or Google in accordance with their refund policies. Under Australian Consumer Law, you may be entitled to a refund if the app has a major failure. To request a refund through Apple, visit reportaproblem.apple.com. For Google Play, visit the Play Store help centre.

Price changes

We will give at least 30 days' notice before any price increase, via email and in-app notification. You may cancel before the new price takes effect.

5. Free trial

New accounts receive a 30-day free trial with full access to all features.

After the trial period ends, if no subscription is active:

• Your cellar data is preserved — nothing is deleted.
• The account switches to read-only mode: you can view all existing wines, tasting notes, and occasions.
• Adding new wines, tasting notes, or using AI features is suspended until a subscription is activated.

Subscribing at any time immediately restores full access.

6. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorised access to any other user's data
• Reverse-engineer, scrape, or abuse the API
• Upload content that is illegal, harmful, or infringes third-party rights
• Use the Service if you are under 18 years of age
• Resell or sublicense the Service

7. Intellectual property

CaveLivre and its original content, design, and branding are owned by us. Your cellar data, tasting notes, and photos remain yours. By uploading content you grant us a limited licence to store and display it for the purpose of providing the Service.

8. Disclaimer & limitation of liability

The Service is provided "as is". We do not warrant uninterrupted availability or error-free operation. To the maximum extent permitted by Australian Consumer Law:

• Our total liability to you for any claim is limited to the subscription fees you paid in the 3 months preceding the claim.
• We are not liable for indirect or consequential loss.

Nothing in these terms limits any rights you have under the Australian Consumer Law (Competition and Consumer Act 2010, Schedule 2) which cannot be excluded.

9. Termination

You may delete your account at any time in Settings → Account → Delete Account. We may suspend or terminate accounts that violate these Terms.

On termination, your data will be deleted within 30 days (see Privacy Policy for exceptions).

10. Governing law

These Terms are governed by the laws of Western Australia, Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of Western Australia, without prejudice to your rights under local consumer protection laws in your country of residence.
